Back in the Dark Ages you were considered guilty until proven innocent and EA goes by the same rule, if you are reported they'll suspend or ban you, then they look into if the creation is in violation of the rules or not. Also, if a creation is gross or extremely gory it is NOT in violation of the rules. Spore is rated E10+ for animated blood, comic mischief, and fantasy violence.
